IN DEED TO SECURE DEBT
STATE OF GEORGIA
COUNTY OF BURKE
On the 20th day of March 1998, DAVID R.M. PUGH and SHAWNA L. PUGH, ("Pugh"), executed a Note and Deed to Secure Debt for $154,590.00, payable to Jim Walter Homes, Inc., conveying property described in Exhibit "A" attached, and recorded in the Office of the Clerk of Superior Court of Burke County, Georgia, in Deed Book 242, Pages 853-855, both of which were subsequently assigned to William J. Wade, not in his individual capacity, but solely in his capacity as trustee for Mid-State Trust VII, ("Wade") by assignment dated February 20 2002, and recorded in aforesaid Clerk's Office.
Default has been made in the installment payments due for January 2001, and subsequent thereto. Wade declared the entire unpaid indebtedness due and payable in accordance with the terms of said Note, and the same has not been paid.
The Deed to Secure Debt provides that when the Note secured thereby becomes due and is not paid, that said property may be sold before the Courthouse door of Burke County, Georgia, upon Wade first giving notice of the place and terms of such sale (1) time a week for (4) weeks in the newspaper in which the sheriff's advertisements are published, and where said property is located.
NOW THEREFORE, pursuant to the powers contained therein, the property will be sold before the Courthouse door in Burke County, Georgia, at public outcry on the first Tuesday in May 2002, between the legal hours of sale.

NOTICE OF SALE UNDER POWER
WHEREAS, on May 27, 1999, for value received, Mary E. Diotte executed and delivered to the United States of America, acting through the United States Department of Agriculture, a Deed to Secure Debt conveying certain real estate located in Burke County, Georgia, and said Deed to Secure Debt was recorded in the Office of the Clerk of the Superior Court for Burke County, Georgia, in Book # 274, Page # 216-221; and
WHEREAS, the United States of America now holds the above described security deed covering the said real estate; and
WHEREAS, the Deed to Secure Debt held by the United States of America provides that should default occur, the holder may declare the entire indebtedness secured by the Deed to Secure Debt due and payable and, in compliance with the power of sale provisions contained in said security deed proceed to sell the property at public outcry; and
WHEREAS, after default, the United States of America has declared all of the indebtedness secured by the Deed to Secure Debt due and payable and hereby certifies that it has complied with all of its loan servicing regulations;
NOW, THEREFORE, the said United States of America, acting as aforesaid, under and in compliance with the power of sale provision contained in the Deed to Secure Debt, will proceed to sell at public outcry, for cash or certified funds to the highest bidder in front of the Courthouse in Burke County, during the legal hours of sale, on the 7th day of May, 2002, the following-described property conveyed in the Deed to Secure Debt, to Wit:
All that tract, lot or parcel of land, lying and being in the City of Waynesboro, 60th G.M.D., Burke County, Georgia being Lot 7, Section 1-D, Spring Valley Subdivision and more particularly shown and described containing 0.41 acres upon a plat of survey entitled Survey for Ellen E. Diotte prepared by Troy Smith & Associates, Surveyor, Ga. Reg. No. 2459 dated April 20, 1999. Said plat of survey was recorded in the Office of the Clerk of Superior Court of Burke County, Georgia in Plat File No. A-8381 on 5/27/99. Said plat of survey is by reference incorporated herein and made part hereof.
This conveyance also secures future advances and all other present or future indebtedness of Grantor to Grantee, whether direct, indirect or contingent, together with all extensions or renewals thereon, which extensions and renewals shall be at the sole option of the Grantee.
The above described property will be sold subject to any and all outstanding real estate taxes that are due and payable.
The failure of any high bidder to pay the purchase price and close the sale shall, at the option of the United States of America, be cause for rejection of the bid, and, if the bid is rejected, the United States of America shall have the option of making the sale to the next highest bidder who is ready, willing and able to comply with the terms thereof. The proceeds of said sale will first be applied to the payment of the indebtedness to the United States of America, other charges, and the expenses of sale, as provided in the above-described Deed to Secure Debt.

Under and by virtue of the Power of Sale contained in a Security Deed given by Danny W. Rowland and Tanya L. Rowland, to Mortgage Electronic Registration Systems, Inc. (MERS) solely as nominee for Taylor, Bean, & Whitaker Mortgage Corp., dated January 8, 2001, recorded in Deed Book 322, Page 240, Burke County, Georgia Records, as last transferred to Mortgage Electronic Registration Systems, Inc. by assignment to be recorded in the Office of the Clerk of Superior Court of Burke County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of ONE HUNDRED THIRTY-ONE THOUSAND AND 0/100 DOLLARS ($131,000.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the Courthouse door of Burke County, Georgia, within the legal hours of sale on the first Tuesday in May, 2002, the following described property:
All that tract or parcel of land lying and being in the 60th Militia District of Burke County, Georgia, being known as Lot 3, Middleground Heights Subdivision, containing 1.0 acre, more or less, and being more particularly shown and described according to a plat of survey prepared by Jones Land Surveying, dated December 19, 2000, and being described as follows: Beginning at an iron pin on the center line of Loren Lane a distance of 338.59 west of the Middleground Road; thence South 2 degrees 2 minutes 50 seconds West a distance of 252.57 feet to an iron pin; thence South 84 degrees 59 minutes 31 seconds East a distance of 160.06 feet to an iron pin; thence North 2 degrees 2 minutes 50 seconds East a distance of 277.40 feet to the center line of Loren Lane, and thence North 88 degrees 30 minutes 46 seconds East a distance of 159.85 feet to the point of beginning.
Said property is improved with a residence known as 520 Loren Lane, Waynesboro, Georgia 30830.
Also a perpetual non-exclusive ingress-egress easement in and to Loren Lane as indicated on said plat, as a means of access to and from Middleground Road.
This lot is conveyed subject to the road easement for Loren Lane as indicated on said subdivision plat.
This property is subject to residential purposes as shown on deed recorded in Deed Book 315, page 197, Burke County Records.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
